WAIVER OF LIABILITY AGREEMENT

This agreement is between Planet Hope Land and The Catamaran Academy (School) and above applicant (Student). Student acknowledges his/her responsibility for the safety and proper operation of the vessels and equipment; and for the safety and welfare of other boaters and persons. It is agreed and understood by the Student that the School shall not be held liable for damages or inconveniences caused by an accident, breakdown or malfunction of the vessels or equipment. Student further agrees to indemnify and hold harmless the School, Fort Washington Marina, Instructors and the American Sailing Association from, and against any and all claims for loss of or damage to property of injury to persons (including death) resulting through the use, operation of sailing vessel and participation in sailing courses. Student further agrees to hold the School harmless should loss or damage occur to any of the lessee's personal property while carried in, or on, the boats and facilities of the school, including loss or damage caused by fire, water, theft or any other cause whatsoever. The Student certifies that he/she has read this agreement and understands each item. Should any term or condition of this agreement be held void or unenforceable, then that term shall be deemed severed from this agreement and the enforceability of the remainder shall not be affected and will remain in full force and effect.
